General Terms and Conditions

 

These standard terms and conditions apply to all proposals, quotations and services supplied by EZ-Relocation, with registered address at Hazendreef 9, 2900 Schoten, Belgium registered under Nº: BE 0473 635 459 and AC Transport, with registered address at Predikherenlaan 7/B 7, 2500 Lier, Belgium registered under Nº: BE 0548 892 811 (hereafter: “The Company”). Any alteration or addition to these terms and conditions shall be agreed upon in writing.

“The Client” means the person or company who accepts a quotation of The Company for the supply of services, or whose request for The Company to supply such services to The Client is accepted by The Company.

“The Transferee” means the person or persons for whom the client has ordered the services.

“Services” means one or more of the following: a rental home search, rental contract negotiation, assistance in residence and/or work permit application, relocating in/relocating out services, or any other typical services described in the offer relating to relocating to Belgium.

Article 1
Proposals and quotations supplied by The Company are free of obligation and fees specified are valid for a period of three (3) months from the date of the proposal. Proposals accepted after that time may be subject to increased prices if a price rise has been applied since the date of the proposal.

Article 2
An agreement to perform services is valid from the date of receipt by The Company of an e-mail and/or fax requesting assistance for a specific employee or a copy of their proposal, signed by the client. Any alterations or amendments to the agreement shall also be agreed upon in writing.

Article 3
Either party is entitled to terminate the agreement, subject to one (1) months’ notice, following written confirmation and payment of all outstanding fees, including those incurred by third parties.

Article 4
The services of The Company are supplied exclusive of Belgian Value Added Tax (BTW), which will be added at the appropriate rate.

Article 5
Invoices are to be settled within thirty (30) days of the date of issue, unless otherwise agreed. If the invoice is not paid within the agreed period, The Client will be liable, without any further notice, to an interest payment of one point five percent (1.5%) of the outstanding invoice sum for every month or part of, that the invoice remains unpaid.

Article 6
Any judicial or other costs incurred by EZ-Relocation, resulting from the client’s failure to meet their obligations and in the case of a bankruptcy petition or the closing down of the client’s business, shall be borne by the client.

Article 7
The Company reserves the right, in consultation with the client, to alter or postpone services or appointments to a later date, due to unforeseen circumstances at the time of agreeing services.

Article 8
If The Client requests any variation to the project, The Company will seek to meet the request. If this results in extra time being taken then this will be charged at the then prevailing rate.

Article 9
The Company cannot be held responsible for any negative decision or refusal by the Belgian immigration or justice departments to issue Work, Residence or any other applicable permits, based on information provided by the client.

Article 10
In case the services requested includes a search for a rental accommodation, The Company will use its best effort to select a reasonable number of accommodations that best meet the Client’s requirements. The final selection of a rental accommodation remains the sole responsibility of the Client.

Article 11
Each party shall keep confidential all information obtained from the other pursuant to the contract of which these Terms are part and shall not divulge information to any third party without the other’s prior written consent. Each party should ensure that its servants, agents, employees and sub-contractors are bound by the provisions of this clause.

Article 12
The Client will indemnify The Company for any loss, claim, damage or expenses incurred by The Company as a result of any breach of the contract of which these Terms are part by The Client without The Company consent.

Article 13
All transactions entered into between The Company and its clients shall be subject to and be construed in accordance with the laws of Belgium and subject to the exclusive jurisdiction of the courts of Antwerp.

Article 14
The Company shall not be liable for any default resulting from causes beyond its reasonable control.

Article 15
All services (including advice) are provided on a best effort basis to the Client and/or Transferee and under no circumstances does EZ-Relocation warrant that advice given is complete or correct.
